CLÍNICA ESPREGUEIRA
“, based in Estádio do Dragão, Porto, which has as one of its objectives the training of health technicians, through the design, development, monitoring and evaluation of training interventions in the fields of knowledge related to health, therapy and rehabilitation and sport.

“Academia Clínicas Espregueira” promotes the development of training programmes in the form of face-to-face and distance learning (e-learning and b-learning).

The purpose of these Training Operating Rules is to systematise and standardise procedures relating to the training activities carried out by “Academia Clínicas Espregueira” in the form of distance learning.

As an instrument based on flexible principles, these Training Operating Rules will be updated whenever there are changes in the organisation and operation of the training activity carried out.

The general operating rules governing the “Academia Clínicas Espregueira” training activity include all the rules applicable to face-to-face training, plus specific rules for distance learning.

Academia Clínicas Espregueira‘s distance learning courses are carried out, in particular, but not limited to, via the distance learning platforms https://moodle.org/ and https://zoom.us/sendo. Attendance at these courses requires the following technical requirements:

  • Computer with internet access;
  • Open Office or MS Office;
  • Acrobat Reader.

Access to the platform is via https://www.insia.pt/

a. Enrolment

Access to the training courses run by the “Academia Clínicas Espregueira” is gained by filling in the enrolment form available at www.academiaclinicadragao.com or by contacting the services available to Participants directly. Enrolment is confirmed by Academia Clínicas Espregueira” by email.

After registering for the training course, Participants will be sent access details to the distance learning platform, which will be valid until the end of the training course. Academia Clínicas Espregueira disclaims any liability for access and/or utilisation problems other than those exclusively related to the distance learning platform.

The Participant approves, by accepting these Regulations, and on honour, that the data they fill in when registering on the training platform constitutes true information relating solely and exclusively to them.

The personal data provided by the Participant when registering and/or communicated to Academia Clínicas Espregueira is protected by law and is strictly necessary to identify the Participant and will be included in a database.

Access data, as well as all messages sent within the scope of the training to the e-mail address provided by the Participants, are personal, non-transferable and for exclusive use within the scope of the management of the training course in question. These data are not transferred by ACADEMIA CLÍNICAS ESPREGUEIRA for use and/or consultation by third parties.

The Participant has the right to consult and change the data relating to their enrolment by simply doing so in their reserved area, which they access using the credentials sent when confirming enrolment and after payment.

The ACADEMIA CLÍNICAS ESPREGUEIRA is responsible for processing this data, complying with the Data Protection provisions implemented by the organisation, which guarantees its confidentiality and security.

b. Selection

Enrolment on any course must comply with specific requirements, in terms of qualifications or experience, where applicable. The criterion for acceptance, once the specific requirements have been met, will be in order of enrolment.

ACADEMIA CLÍNICAS ESPREGUEIRA may refuse an enrolment, namely when it considers that the trainee’s qualifications do not meet the defined prerequisites.

Enrolment is limited to the number of places available. If, when registering online, the number of places has already been filled, even though this may be possible through our website, the trainee will then be contacted by ACADEMIA CLÍNICAS ESPREGUEIRA, informing them that it is impossible to accept their registration and of the procedure to be followed in order to refund the amount already paid, if this is the case.

The timetables and schedule for the training courses are set out in the promotional material for each course. ACADEMIA CLÍNICAS ESPREGUEIRA may replace teachers in the event of unavailability or unforeseen circumstances related to them. may make changes to the timetable and/or schedule of the training course whenever necessary, for reasons of force majeure or other duly justified reasons, provided that this does not jeopardise the objectives initially set for the course. In such cases, ACADEMIA CLÍNICAS ESPREGUEIRA undertakes to communicate the changes made as far in advance as possible to all registered trainees.

After the start of the training, Participants will have to carry out a series of learning activities, and time management is their responsibility; however, they must take into account the deadlines set for carrying out the tasks/activities. Progression in the training course is dependent on completing the tasks/activities that are compulsory.

Distance learning courses can operate as e-learning, with synchronous sessions (a component of the training in which the intervention times of the trainee and trainer, although mediated by a given process or technology, are simultaneous) or asynchronous sessions (a component of the training in which the intervention times of the trainee and trainer, mediated by a given process or technology, are time-lagged), or blended learning, which combines joint face-to-face sessions and online, synchronous or asynchronous non-face-to-face sessions.

Participants can access course content at any time of the day or night, depending on their availability and schedule, with the only restrictions being synchronous sessions and the course end date.

In asynchronous sessions, communication and collaboration are established without simultaneity of time, allowing users of the system to interact according to their own rhythm and schedule, namely through email or other collaboration tools, tests, assignments and/or other types of assessment. In asynchronous tutoring, the Participant has the support of the trainer in charge who, on an individualised basis, will answer their questions and clarify their doubts via forums, where applicable.

In synchronous sessions, communication and collaboration is established in real time, namely through chat, audio conferencing, web conferencing or application sharing. In the synchronous sessions, the Participant has the support of the trainer in charge who, in addition to covering the programme content assigned to the training, will answer their questions and clarify their doubts in real time.

The training courses are taught in Portuguese. However, for some courses or for a particular training course given by a foreign trainer, as expressed in the promotional material for each training course, the Trainee must have a knowledge of technical English: it is advisable for the Trainee to be able to understand the language and technical manuals in English.

Registration, enrolment and access credentials are personal and non-transferable and can only be used by the Participant.

All messages sent to the e-mail address in the Participant’s registration are intended solely and exclusively for the Participant and may not be copied, reproduced, given for consultation or use, or in any other way, to other individuals or entities.

All texts, images, interactive services and other services made available on the distance learning platform are for the sole and exclusive use of the Participant and may not be transferred to third parties.

The texts, images, sounds, interactive services and other materials or services made available, hereinafter referred to as content, are intended to be used for the exclusive purpose of attending the training provided by ACADEMIA CLÍNICAS ESPREGUEIRA and may not be copied, sent to third parties, reproduced, quoted or manipulated, in whole or in part, viewed by persons other than regularly registered Participants, without prior authorisation from ACADEMIA CLÍNICAS ESPREGUEIRA .

 

All content made available is the property of ACADEMIA CLÍNICAS ESPREGUEIRA and may not be copied, reproduced, marketed, quoted or manipulated, in whole or in part, without the prior written authorisation of ACADEMIA CLÍNICAS ESPREGUEIRA. Unauthorised sharing and use of audiovisual content will trigger legal action by ACADEMIA CLÍNICAS ESPREGUEIRA.

Downloading any training content, including but not limited to video lessons, is expressly prohibited and punishable by law. The recorded lessons will only be available for viewing on the platform, in a secure and restricted manner, guaranteeing the protection of the content and respecting the copyright and intellectual property of the training.

By registering, you consent to ACADEMIA CLÍNICAS ESPREGUEIRA collecting and disseminating image and/or video records in which your image and voice may be integrated into the overall context of the training. ACADEMIA CLÍNICAS ESPREGUEIRA may collect images, videos and sounds (including voice) during the course of the training. Images or videos will always be taken in the overall context of the training and only released for future educational and promotional purposes. If, when consulting a publication made by ACADEMIA CLÍNICAS ESPREGUEIRA, you detect any image that you do not wish to remain published, you may request its immediate deletion by contacting ACADEMIA CLÍNICAS ESPREGUEIRA to that effect.

Attendance records are kept by accessing and remaining on the platform. In this case, signing the attendance sheet is not required, although the procedure for justifying absences is maintained as it is for face-to-face training.

Trainees will only be able to access summative assessments once they have completed a minimum of 70% attendance.

This attendance must be monitored and can be achieved through, but is not limited to: (i) live online participation; full viewing of class recordings; face-to-face attendance, in the case of face-to-face training.

It is essential that minimum attendance is met in advance and within the timeframe stipulated for the summative assessment.

a. Payments

The Participant only has access to the desired course once they have registered and paid for it before the course begins. When completing the enrolment, the Participant must confirm the personal data contained in their registration, which will be used for the purposes of issuing the Professional Training Certificate.

b. Refunds

Requests to withdraw from a registration must be submitted by email to:[email protected] , indicating the event in question.

Without prejudice to the right of withdrawal, where applicable, all cancellations are subject to a non-refundable fee of 25% of the registration fee (administrative costs). Up to 15 days before the date of the training, in the event of a cancellation, 75% of the amount actually paid will be refunded. All cancellations less than 15 days before the training date are subject to a non-refundable fee of 100% of the registration fee. Trainees who are unable to take part in the training may be replaced by another Trainee, provided that the latter fulfils the requirements for attending the course and the details to be entered on the registration form are communicated before the start date of the training course. Whenever a training course does not have the minimum number of Trainees on the start date, it may be cancelled and the Trainees will be reimbursed the full amount paid to date.

ACADEMIA CLÍNICAS ESPREGUEIRA undertakes to refund the amounts paid in the event that it is unable to guarantee the operation of the advertised course and cancels it, with no compensation being payable to those enrolled.

By registering and/or using any content or service made available, the Participant agrees to be governed by rules and conduct of good manners.

ACADEMIA CLÍNICAS ESPREGUEIRA reserves the right to edit or remove any message or communication made by the Participant, in particular messages posted on the course discussion forum/chat, if they are offensive to public morals or are unrelated to the subject matter of the courses.

The Participant undertakes to act in good faith when using the platform and recognizes that he/she is prevented from any immoral or illicit act committed against the entity and/or the technological training resources applied.

To use the platform where the distance training takes place, the Participant needs internet access, access to a computer, speakers and microphone, camera (preferred).

Other technical requirements needed to attend a particular course, particularly in terms of equipment and software, are mentioned on the course description page.

The assessment criteria for courses are specified in the training program and on the course page, including evaluation, the result of assessment tests/assessment work, attendance and participation in the discussion forum. The specific weight of each of these elements results in the final mark.

During the period of the course, it is the Participant’s duty to attend the course, ensuring that the work proposals and assessment tests/assignments are completed and that they participate in the proposed dynamics.

It is up to the technical-pedagogical team to support the Participant in matters not directly related to the course themes, such as clarifying the course objectives and program, the available editions, the operation of the course and the platform.

The Participant can also turn to the Pedagogical Coordinator of the course if they feel that there are pedagogical flaws in the course, that the trainer’s performance is inadequate or that the technical-pedagogical team has failed to answer their questions correctly.

It is the Training Manager’s responsibility to ensure support for training management, pedagogical monitoring of training activities and liaison with Participants.

The Participant recognizes that in order to be successful in the course they will have to comply with the course assessment criteria.

The Participant recognizes that there may be failures in accessing the platform, particularly for technical updates, whether planned or not.

ACADEMIA CLÍNICAS ESPREGUEIRA will make every effort to maintain the correct functioning of the e-learning platform, endeavoring to guarantee its accessibility 24 hours a day, 7 days a week. However, it cannot be held responsible for any technical failures or difficulties in operation caused by external factors.

The registered Participant has the right to contact the trainers of the respective courses in which they are registered, via the forums created for this purpose on the platform.

ACADEMIA CLÍNICAS ESPREGUEIRA ensures the assessment of learning in order to gauge the extent to which Participants have acquired the knowledge and skills that fulfil the training objectives.

Assessment is an integral and fundamental element of training. The courses include assessment of knowledge/learning – qualitative or quantitative. Assessment will be carried out in accordance with the specific objectives of each course, and different assessment instruments may be used for this purpose, including knowledge tests, assignments, among others.

The type of assessment will be defined according to the characteristics of each course and its training program. The trainers, after analyzing the syllabus, the respective programs and the duration of each module, define the times and forms of assessment, according to the methodology previously agreed with the Pedagogical Coordinator.

The evaluation also includes an assessment of satisfaction, materialized in a questionnaire: program content and methods; an assessment of the e-trainer’s performance; an overall assessment of the training, after which a Training Evaluation Report is generated, which reflects the assessment of each training course.

As a general rule, in order to be considered successful, the Participant must obtain a mark of ten or more (on a scale of 0 to 20). If there are other rules, these will be communicated to participants in advance. The Participant’s final mark corresponds to the arithmetic mean of the evaluations obtained on a scale of 0 to 20.

Successful completion of the training also results in the award of a Professional Training Certificate.

Participants who successfully complete the training will be issued with a Vocational Training Certificate via SIGO – Sistema de Informação e Gestão da Oferta Educativa e Formativa, in accordance with Ministerial Order 474/2010 of 8 July.

The training certificate will be issued within 30 working days of the end of the training course and will be sent by ACADEMIA CLÍNICAS ESPREGUEIRA, in digital format, to each Participant.

ACADEMIA CLÍNICAS ESPREGUEIRA training events aim to provide trainees with the acquisition of new knowledge and improvement in their field. They do not replace the study plan for access to a regulated profession, nor do they attribute any professional title or category, and there are no other commitments or guarantees other than those expressly provided for and assumed in the program and objectives of the respective training.

Trainees should promote the exercise of safe and responsible practices, respecting the limits of their professional qualifications and technical skills, always safeguarding the applicable professional and ethical standards, and should never assume that attendance at any ACADEMIA CLÍNICAS ESPREGUEIRA training is a sufficient condition for carrying out practices contrary to their professional limitations.

ACADEMIA CLÍNICAS ESPREGUEIRA reserves the right to terminate the contract at any time if the Participant violates, threatens to violate or demonstrates that they do not intend to comply with these Regulations, without the right to any compensation or indemnity.

Any changes to the Regulations must be communicated to users of the platform by the means that ACADEMIA CLÍNICAS ESPREGUEIRA deems most appropriate.

If the Participant does not expressly communicate their non-acceptance of the new Regulations, but continues to use the site, their acceptance is tacitly assumed.

The Participant acknowledges that, even if they waive the Regulations, they may be held legally liable for copyright infringement, offences, debts and all consequences that may arise, directly or indirectly, from the misuse of the platform service and/or its contents and that the provisions relating to the reserved use of texts, images and services, the rules of conduct and the Participant’s registration data.

If the Participant does not comply with the regulations or fails to pay the registration fees, ACADEMIA CLÍNICAS ESPREGUEIRA reserves the right to cancel the contract with immediate termination.

a. Participant/Trainee

Participants who attend a distance training course for a certain period of time, with the aim of acquiring the knowledge, skills and attitudes required for the exercise of their profession, have the following obligations:

  • Receiving quality training in accordance with the objectives, program, methodology and timetable established for the respective training course;
  • Having access to the didactic resources needed to attend the training course, in accordance with the agreement;
  • To be treated with respect and loyalty by colleagues, e-trainers, coordinators and other stakeholders;
  • Request support to fulfil the objectives;
  • Participate in the training satisfaction questionnaire;
  • Submit any suggestions, compliments, complaints or testimonies about the training process;
  • Contribute to the normal course of discussions held in forums or group work;
  • Regularly benefit from the support established in the applicable legislation;
  • Receive a Vocational Training Certificate in digital format at the end of the training, subject to obtaining the required attendance. Take the knowledge assessment tests to which they may be submitted;
  • Participate in the training satisfaction questionnaire;
  • To have the confidentiality of the personal data provided in the enrolment process or during the training protected, in accordance with the law in force.

The Participant/Trainee undertakes to:

  • Pay the price within the time limit and under the conditions laid down;
  • Sign and fulfil the training contract and submit all documentation requested by ACADEMIA CLÍNICAS ESPREGUEIRA;
  • Attend the event with assiduity and punctuality, in order to acquire the theoretical and practical knowledge given;
  • For the purposes of access control, the Participant/Trainee must identify him/herself by first and last name in the synchronous sessions and answer the questions put to him/her by the Trainer in order to assess the quality of Participant/Trainee; failure to identify and/or inability to assess the quality of Participants/Trainees due to failure to answer the questions asked will result in exclusion from the virtual room until the identity of the Participant/Trainee is confirmed.
  • Participate actively in the theoretical and practical sessions, particularly in group activities;
  • Take the knowledge assessment tests to which they are submitted with dignity and a sense of responsibility;
  • Treating trainees, trainers, coordinators and other staff representing ACADEMIA CLÍNICAS ESPREGUEIRA with courtesy;
  • Respect the rules and conduct of good manners in accordance with the customs of Portugal and undertake to address and interact with employees, trainers in a correct and polite manner. ACADEMIA CLÍNICAS ESPREGUEIRA reserves the right to edit or remove any messages posted on the discussion forum which expose the normal running of the training or which are offensive or unrelated to the course content, and may lead to the suspension of the trainee’s use of the online service if this practice is repeated or considered serious.
  • Use with care and ensure the proper conservation of equipment and other property entrusted to them for training purposes;
  • Consult ACADEMIA CLÍNICAS ESPREGUEIRA whenever there are relevant questions, and have the right to clarification;
  • Loyalty to the training organization, refraining from any act which could harm or discredit the training provided by ACADEMIA CLÍNICAS ESPREGUEIRA;
  • Comply with all other legal and contractual duties.

b. Trainer

Qualified trainer with specific academic and professional qualifications, whose intervention facilitates the acquisition of knowledge and/or the development of technical and behavioral skills and competences. This includes:

  • Having the teaching materials and administrative and logistical support needed to carry out the training course as planned;
  • Access to the results of the evaluation carried out by the Participants;
  • Responding to any information, evaluations or complaints arising from their performance or actions;
  • Develop the course assigned to them, in terms of planning, execution and evaluation;
  • Facilitate the acquisition of knowledge and/or the development of skills, attitudes and forms of behavior;
  • Guiding the entire pedagogical process, as well as all the situations that occur on the e-learning platform;
  • Evaluating participants;
  • Selecting, preparing and making available teaching materials to support the training course, when required;
  • Communicate with the Training Manager and/or Training Coordinator any serious event that prevents the normal running of the course;
  • Communicate immediately if there are any unforeseen circumstances that prevent them from attending the synchronous session of the course;
  • Attend meetings to prepare, monitor and evaluate the training whenever called upon;
  • Provide truthfully any information requested at any time;
  • Conduct themselves in accordance with the principles of equal treatment of all agents involved in the action, refraining from discrimination on the grounds of gender, ethnic-religious affiliation or any other ideology.

c. Responsible for Distance Learning

Qualified Pedagogical Coordinator with responsibility for supporting the management of the training and its pedagogical management, ensuring liaison between all the elements involved. Qualified Training Manager with responsibility for planning, executing, monitoring, controlling and evaluating the training activity. Both involve:

  • Opening and closing courses following the procedures established for this purpose;
  • Monitoring the course of training;
  • Ensuring that the course runs smoothly, supporting the participant and the trainer during the course;
  • Ensuring the planning, implementation, monitoring, control and evaluation of the activity plan;
  • Managing the resources allocated to training;
  • Liaising with the bodies responsible for the Certification System;
  • Ensuring the management, configuration and assistance of the platform for its correct operation;
  • Organizing the logistics necessary for the courses to run and guaranteeing the availability of content and the use of various teaching materials in written, audio, video, computer or multimedia formats;
  • Implementing training quality mechanisms and guaranteeing the implementation of training practices so that they are in harmony with certification requirements.

All complaints must be substantiated with reasons for dissatisfaction and sent within 10 working days of the action that gave rise to them. Complaints must be sent to the attention of the Training Manager (by letter to the address of ACADEMIA CLÍNICAS ESPREGUEIRA or to the following e-mail address: [email protected]) and a written response is guaranteed to all complaints submitted within a maximum of 10 working days of receipt by ACADEMIA CLÍNICAS ESPREGUEIRA.

In accordance with Article 1(2) of Decree-Law 156/2005 of 15 September, as amended by Decree-Law 371/2007 of 6 November, ACADEMIA CLÍNICAS ESPREGUEIRA makes the Complaints Book available on its premises to all those who request it. The existence of the Complaints Book is duly signposted in a visible place at the entrance to the organization.

The Participant has the right to terminate the contract, without having to give any reason, within 14 (fourteen) days from the day on which the contract was entered into. The Participant may exercise his or her right to terminate the contract by sending the decision to terminate the contract by post to the address of ACADEMIA CLÍNICAS ESPREGUEIRA, or via [email protected]. The Participant’s right to terminate the contract within the deadline is considered to have been exercised when the termination is sent before the deadline expires.

All cases in which the execution and supply of digital content not supplied on a material medium begins with the prior express consent of the Participant and the Participant recognizes that his or her consent implies the loss of the right of withdrawal shall constitute exceptions to the right of withdrawal set out in the previous point.

In accordance with the GDPR in force, ACADEMIA CLÍNICAS ESPREGUEIRA undertakes not to disclose the data provided to third parties, the use of which is exclusive to the management of the training activity. The personal data provided by participants and collaborators is used exclusively for the organization, operation and evaluation of the training activities in which they are involved.

The personal data of training participants collected as part of the enrolment and attendance process for any ACADEMIA CLÍNICAS ESPREGUEIRA course, namely name, ID card number, expiry dates, tax number, address, email address, telephone numbers, date of birth, educational qualifications, or other, are processed and included in automated computer files, or in manual files, for which ACADEMIA CLÍNICAS ESPREGUEIRA is responsible.

Personal data is processed exclusively for the purposes of managing the individual files of those involved in the training, as well as for the full fulfilment of the contractual and legal obligations inherent to the course in question, the purposes of which are essentially as follows: management of applications and enrolments, assessment and certification procedures, access control, attendance, timetable and attendance, provision or sending of information and study material, human resources management, remuneration processing, staff selection and recruitment.

The personal data collected from those involved in the training may be passed on to the entities responsible for certifying the course or by virtue of compliance with the rules established in national and international partnerships or agreements in the field of Training, if they exist and exclusively for this purpose, even in these cases, always with the express consent of their holders with the signing of the respective training contract.

The personal data of those involved in the training will only be kept for the period strictly necessary for the purposes for which they are processed.

ACADEMIA CLÍNICAS ESPREGUEIRA may process special categories of data, namely data relating to health, when necessary to fulfil legal obligations to which it is subject, for reasons of public interest in the field of public health, collaborating with the Health Authorities in the control of infectious diseases, without prejudice to the right to individual data protection of the respective holders.

Any of those involved in the training may exercise their right to object, to information, access, portability, rectification and deletion of data, by writing to ACADEMIA CLÍNICAS ESPREGUEIRA.

If any of the training participants’ rights in terms of personal data protection are not respected, they may lodge a complaint with the National Data Protection Commission using the form at www.cnpd.pt.

In compliance with Law no. 144/2015 of 8 September, in the event of a dispute, the Participant has alternative means of resolving consumer disputes and may resort to CICAP – Centro de Informação de Consumo e Arbitragem do Porto with website at: http://www.cicap.pt and headquarters at Rua Damião de Góis, 31, loja 6, 4050 – 225 Porto.

These Operating Rules for Training at ACADEMIA CLÍNICAS ESPREGUEIRA – Distance Learning mode, come into force on 1st April 2022.

 

As part of the exceptional and temporary measures to respond to the epidemiological situation caused by the SARS-CoV-2 coronavirus and the COVID-19 disease, imposed by the national authorities, ACADEMIA CLÍNICAS ESPREGUEIRA will favour distance learning. This recommendation will be in force for as long as the current epidemiological situation persists.

OPERATING RULES FOR FACE-TO-FACE TRAINING

ACADEMIA CLÍNICAS ESPREGUEIRA is a private limited company with a profit motive, created in 2004, with its headquarters in Estádio do Dragão, Porto. One of its objectives is the training of health technicians through the design, development, monitoring and evaluation of training interventions in the fields of knowledge related to health, therapy and rehabilitation and sport.

ACADEMIA CLÍNICAS ESPREGUEIRA promotes the development of training activities in the form of face-to-face and distance learning (e-learning and b-learning).

The purpose of these Training Operating Rules is to systematize and standardize procedures relating to the training activities carried out by ACADEMIA CLÍNICAS ESPREGUEIRA in face-to-face training.

Access to the training courses provided by ACADEMIA CLÍNICAS ESPREGUEIRA is achieved by filling in the enrolment form available on the website www.academiaclinicadragao.com or by contacting the services of www.academiaclinicadragao.com directly. Enrolment is confirmed by ACADEMIA CLÍNICAS ESPREGUEIRA by email, after receipt of the enrolment form and proof of payment by the Trainee.

Enrolment depends on acceptance of the rules of these Training Regulations, the Privacy Policy of the www.academiaclinicadragao.com website and the terms and conditions defined on the website.

Enrolment on any course must comply with specific requirements in terms of qualifications or experience, where applicable.

In exceptional cases, and duly identified in the promotional material for the training course, a selection interview may be carried out with potential trainees.

The criterion for acceptance, if the specific requirements are met, will be in order of enrolment.

ACADEMIA CLÍNICAS ESPREGUEIRA may refuse an enrolment, namely when it considers that the trainee’s qualifications do not meet the defined prerequisites.

Training sessions are subject to the existence of a minimum number of formal enrolments. The minimum number of enrolments for each training course is defined in advance and may vary depending on the course.

If, when registering online, the number of places has already been filled, even though the course may be available through our website, the Trainee will then be contacted by ACADEMIA CLÍNICAS ESPREGUEIRA, which will notify the Trainee that it is impossible to accept their registration and the procedure to be followed in order to refund the amount already paid, if this is the case.

The Training Operating Rules are made available by ACADEMIA CLÍNICAS ESPREGUEIRA in digital format to all Trainees of the training courses.

The rest of the teaching material is made available to Trainees on the training start date. All the teaching materials used in the training are made available for support and consultation by the Trainees, with the exception of those that cannot be made available due to copyright or other legal nature of ownership. Copying or reproducing this content is expressly forbidden, except in situations where authorization has been granted by ACADEMIA CLÍNICAS ESPREGUEIRA.

Training courses are taught in Portuguese. However, for some courses or for a particular training course given by a foreign trainer, the trainee must have a knowledge of technical English: it is advisable for the trainee to be able to understand technical language and manuals in English.

 

a. Definition and alteration of timetables, venues and timetable

The times, locations and timetable for the training courses are set out in the promotional material for each course. ACADEMIA CLÍNICAS ESPREGUEIRA may replace teachers in the event of unavailability or unforeseen circumstances related to them, make changes to the timetable, location and/or schedule of the training course whenever necessary, for reasons of force majeure or other duly justified reasons, provided that this does not expose the objectives initially set for the course. In such cases, ACADEMIA CLÍNICAS ESPREGUEIRA undertakes to communicate the changes made as far in advance as possible to all registered trainees.

b. Interruptions and Repeats

ACADEMIA CLÍNICAS ESPREGUEIRA ensures that the training sessions are held on the dates announced, although these may occasionally be altered for reasons of force majeure or other duly justified reasons. All changes are communicated to trainees as soon as possible and do not entitle them to any compensation. Whenever the interruption of a training course is the sole responsibility of ACADEMIA CLÍNICAS ESPREGUEIRA, a new date will be scheduled for the course, and Trainees will be given the option of taking the course on the new date or reimbursement of the amount already paid. If the interruption of a training course is the sole responsibility of the Trainee, the situation must be reported to the Pedagogical Coordination, which will analyze and decide according to the circumstances presented – each case will be analyzed individually.

a. Payments

The price and payment terms applicable to each training course are indicated in the promotional material. Payment must be settled before the start of the training course and proof of payment sent to: [email protected]. Payments can be made by bank transfer to the NIB provided by ACADEMIA CLÍNICAS ESPREGUEIRA, credit card, ATM or MBway.

b. Returns

Requests to withdraw from a registration must be submitted by email to:[email protected] with an indication of the event in question.

Without prejudice to the right of withdrawal, where applicable, all cancellations are subject to a non-refundable fee of 25% of the registration fee (administrative costs). Up to 15 days before the date of the training, in the event of a cancellation, 75% of the amount actually paid will be refunded. All cancellations less than 15 days before the training date are subject to a non-refundable fee of 100% of the registration fee. Trainees who are unable to take part in the training may be replaced by another Trainee, provided that the latter fulfils the requirements for attending the course and the details to be entered on the registration form are communicated before the start date of the training course. Whenever a training course does not have the minimum number of Trainees on the start date, it may be cancelled and the Trainees will be reimbursed the full amount paid to date.

ACADEMIA CLÍNICAS ESPREGUEIRA undertakes to refund the amounts paid in the event that it does not guarantee the operation of the advertised course and cancels it, with no compensation being paid to those enrolled.

For the purposes of obtaining the Training Certificate, ACADEMIA CLÍNICAS ESPREGUEIRA defines 90% attendance as the minimum percentage of the total workload of the training that is compulsory for awarding the training certificate. Any change to this attendance rate will always be communicated by ACADEMIA CLÍNICAS ESPREGUEIRA to all registered trainees before the training begins.

ACADEMIA CLÍNICAS ESPREGUEIRA ensures the assessment of learning in order to gauge the extent to which Trainees have acquired the knowledge and skills that fulfil the training objectives.

Assessment is an integral and fundamental element of training. The courses include assessment of knowledge/learning – qualitative or quantitative. Assessment will be carried out in accordance with the specific objectives of each course, and different assessment instruments may be used for this purpose, such as knowledge tests, assignments, among others.

The type of assessment will be defined according to the characteristics of each course and its training program. The trainers, after analyzing the syllabus, the respective programs and the duration of each module, define the times and forms of assessment, according to the methodology previously agreed with the Pedagogical Coordinator.

The evaluation also includes an assessment of satisfaction, materialized in a questionnaire: program content and methods; assessment of the trainer’s performance; overall assessment of the training, after which a Training Evaluation Report is generated, which reflects the assessment of each training course.

As a general rule, for the Trainee to be considered to have succeeded, it is essential that they obtain a mark equal to or greater than ten (on a scale of 0 to 20). If there are any other rules, these will be communicated to the trainees in advance. The trainee’s final mark is the arithmetic mean of the assessments obtained on a scale of 0 to 20.

Trainees will only be able to access summative assessments once they have completed a minimum of 70% attendance.

This attendance must be monitored and can be achieved through, but is not limited to, recording attendance in person.

It is essential that the minimum attendance is met in advance and within the timeframe stipulated for the summative assessment.

 

Successful completion of the training also results in the award of a Vocational Training Certificate.

The practical component is essential for acquiring, perfecting and mastering knowledge, which is why certain ACADEMIA CLÍNICAS ESPREGUEIRA training courses may include and integrate a practical body exercise and manipulation component, to be developed by the Trainee in a classroom context, under the guidance and coordination of the Trainer, in accordance with the Course Plan and specific objectives.

The Trainee undertakes to share with the Trainer any and all relevant individual clinical information that may affect their state of health and subjection to the demonstrative interventions, as well as to obtain from the Trainer all the answers and clarifications to any doubts raised, always respecting the principles of professional ethics and deontology.

Participation in such interventions, whether carried out by the trainer or another trainee, will always be a free and voluntary act, and it is the trainee’s right to refuse to submit to any intervention and to withdraw at any time.

By registering, the Trainee declares freely and voluntarily that he/she intends to take part in the Training Event in question, being fully aware of the risks that the activity and physical effort may entail for his/her health, and taking full and exclusive responsibility for them.

In the event that the Trainee’s general state of health or will should change, he/she undertakes to notify immediately and oppose participation in any interventions or demonstrations of a practical nature.

In cases where the training includes a component of exercise and body manipulation of a practical nature, to be carried out by the Trainee in a classroom context, all Trainees undertake to ensure compliance with the applicable hygiene and safety rules, known and recommended by public authorities in terms of reducing the risks of possible contagion or spread of viruses, bacteria or other pathogenic agents, using the necessary and appropriate personal protective equipment for this purpose, which will be provided by ACADEMIA CLÍNICAS ESPREGUEIRA.

Trainees who successfully complete the training will be issued with a Vocational Training Certificate via SIGO – Sistema de Informação e Gestão da Oferta Educativa e Formativa, in accordance with Ministerial Order 474/2010 of 8 July.

The training certificate will be issued within 30 working days of the end of the training course and will be sent by ACADEMIA CLÍNICAS ESPREGUEIRA, in digital format, to each Trainee.

The certificate may not be issued if i) the Trainee has an attendance rate of less than 90% (ninety per cent) of the total workload provided for the training, ii) if the information provided regarding qualifications is found to be false, iii) in the event that the Trainee reveals a failure to acquire the knowledge and failure to meet the proposed objectives, upon the issue of a written, justifiable and reasoned opinion by the Head Trainer.

The above-mentioned attendance rate may vary depending on the course, and there may be courses where the attendance rate is higher or lower than stipulated in these regulations.

ACADEMIA CLÍNICAS ESPREGUEIRA training events are intended to provide Trainees with the acquisition of new knowledge and improvement in their field. They do not replace the study plan for access to a regulated profession, nor do they attribute any professional title or category, and there are no other commitments or guarantees other than those expressly provided for and assumed in the program and objectives of the respective training.

Trainees must promote the exercise of safe and responsible practices, respecting the limits of their professional qualifications and technical skills, always safeguarding the applicable professional and ethical standards, and must never assume that attendance at any ACADEMIA CLÍNICAS ESPREGUEIRA training course is a sufficient condition for carrying out practices contrary to their professional limitations.

The issue of the certificate will depend on the Trainee’s success, in accordance with the assessment methodology defined and duly enshrined in the respective Training Regulations.

ACADEMIA CLÍNICAS ESPREGUEIRA reserves the right to terminate the contract at any time if the Trainee violates, threatens to violate or demonstrates that they do not intend to comply with these Regulations, without the right to any compensation or indemnity.

Any changes to the Regulations must be communicated to the Trainees by the means that ACADEMIA CLÍNICAS ESPREGUEIRA deems most appropriate.

If the Trainee does not comply with the regulations or fails to pay the enrolment fee, ACADEMIA CLÍNICAS ESPREGUEIRA reserves the right to terminate the contract immediately.

a. Training Manager

Privileged interlocutor with the Certification System, ensuring that the training practices implemented in the organization comply with the requirements of the System and the applicable legislation.

Responsible for the training policy and its general management and coordination, in particular liaising between ACADEMIA CLÍNICAS ESPREGUEIRA and the external environment, listening to market needs and defining training offer strategies, as well as representing ACADEMIA CLÍNICAS ESPREGUEIRA with other organizations and partners. It ensures

  • The planning, execution, monitoring, control and evaluation of the activity plan;
  • Managing the resources allocated to training;
  • External relations relating to training;
  • Promoting contact and sending training proposals to clients;
  • Promoting contact and sending partnership proposals;
  • Ensuring that requests from client or partner organizations are responded to;
  • Ensures the recruitment and selection of trainers;
  • Manages all training activities;
  • Ensures compliance with all the requirements for DGERT Certification of Training Organizations;
  • Promoting continuous review and improvement actions and implementing training quality mechanisms.

b. Pedagogical Coordinator

Responsible for supporting the management of training and its pedagogical management, ensuring:

  • Liaising with the Training Manager;
  • Liaising with and coordinating the team of trainers during the program design phase;
  • Pedagogical monitoring of trainees and trainers during the training implementation phase;
  • Promoting meetings at different times (before, during and after the action) with all the interlocutors necessary for the implementation of the training project;
  • Reformulates with the trainers, if necessary, training strategies and/or instruments for evaluating/monitoring the trainees;
  • Monitors the development of the training project, ensuring all the conditions for carrying out the training activity;
  • Co-ordinates the whole process of evaluating the training project, with a view to identifying needs for improvement;
  • Collaborating in the execution of administrative tasks relating to the training activity (receiving contacts, organizing technical-pedagogical dossiers for training activities, statistical processing of responses to evaluation questionnaires, among others);
  • Collaborating in the execution of logistical tasks inherent to the training activity;
  • Resolving pedagogical and organizational issues, among others.

c. Trainer

The trainer is responsible for the preparation and pedagogical development of the training courses he/she delivers, ensuring:

  • The preparation of the training program;
  • Preparing pedagogical resources for the development of the program, such as session plans, manuals, exercises, etc;
  • Monitoring training activities by applying pedagogical methods appropriate to the recipients and training objectives;
  • Complying with the established timetable as well as the total number of hours planned for the training event;
  • Fully comply with the program content planned for the training event;
  • Clarify with the trainees any questions raised in relation to the topics covered by the training event;
  • Providing trainees with all the documentation (manuals or other) provided for in the conditions of participation;
  • Checking trainees’ attendance and punctuality using the attendance form;
  • Creating and updating all training support documentation;
  • Carrying out an overall evaluation of the training event using the trainer’s training action evaluation questionnaire;
  • Complying with all the procedures related to certification by DGERT or any other applicable body;
  • The application of assessment methods and instruments.

d. Customer Service

  • Provides daily customer service between 9.30am and 12.30pm and 2pm and 6pm and ensures support for the development of ACADEMIA CLÍNICAS ESPREGUEIRA’s training activities.
  • Responding to any requests from the public wishing to contact ACADEMIA CLÍNICAS ESPREGUEIRA, or referring them to the appropriate person if they are unable to respond;
  • Representing the image of ACADEMIA CLÍNICAS ESPREGUEIRA, being responsible for its activities in the eyes of the public;
  • Collaborating in the execution of administrative tasks related to training activities (receiving contacts, organizing technical-pedagogical dossiers for training activities, statistical processing of responses to evaluation questionnaires, among others);
  • Collaborating in logistical tasks inherent to the training activity.

a. Trainees’ rights

  • To receive training in accordance with the established programs;
  • To regularly benefit from the support established in the applicable legislation;
  • To receive, at the end of the training, a Vocational Training Certificate, in digital format, which is conditional on obtaining a pass/verification of compulsory attendance;
  • To have the confidentiality of personal data provided in the enrolment process or during training protected, in accordance with current law;
  • Refuse to carry out activities that are not part of the training program.

 

b. Duties of trainees

  • Pay the price within the time limit and under the conditions laid down;
  • Sign and fulfil the training contract and submit all documentation requested by ACADEMIA CLÍNICAS ESPREGUEIRA;
  • Have the basic ICT (Information and Communication Technologies) skills necessary to fully attend the training courses, ensuring that they have these skills at the time the course starts.
  • Respect the rules and behaviors of good manners in accordance with the customs of Portugal and undertake to address and interact with employees and trainers in a correct and polite manner. ACADEMIA CLÍNICAS ESPREGUEIRA reserves the right to edit or remove any messages posted on the discussion forum that expose the normal running of the Training or that are offensive or unrelated to the course content, and may lead to the suspension of the trainee’s use of the online service if this practice is repeated or considered serious.
  • Attend the training course regularly and punctually in order to acquire the theoretical and practical knowledge that is the subject of the training;
  • Treat the training coordinators, trainers and other trainees and the representatives and employees of ACADEMIA CLÍNICAS ESPREGUEIRA with courtesy;
  • Carefully use and ensure the upkeep of equipment and other property entrusted to them for training purposes;
  • Ensure the upkeep and proper use of the facilities where the training takes place, both those of ACADEMIA CLÍNICAS ESPREGUEIRA and those of the organizations associated with the project in the form of cooperation;
  • Loyalty to the training organization, refraining from any act which could damage or discredit the training provided by ACADEMIA CLÍNICAS ESPREGUEIRA;
  • Notifying the trainer or the pedagogical coordinator of the action of any situation that alters the normal running of the session (absences, delays, withdrawals, etc.);
  • Comply with other legal and contractual obligations.

All complaints must be substantiated by stating the reasons for the dissatisfaction and sent within 10 working days of the action that gave rise to it. Complaints should be sent to the attention of the Training Manager (by letter to the address of ACADEMIA CLÍNICAS ESPREGUEIRA or to the following e-mail address: [email protected]).

In accordance with Article 1(2) of Decree-Law 156/2005 of 15 September, as amended by Decree-Law 371/2007 of 6 November, ACADEMIA CLÍNICAS ESPREGUEIRA makes the Complaints Book available on its premises to anyone who requests it. The existence of the Complaints Book is duly signposted in a visible place at the entrance to the organization.

The final response to the complaint will be presented by ACADEMIA CLÍNICAS ESPREGUEIRA and addressed to the complaining entity/person within a maximum of 15 (fifteen) working days from the date the complaint was received.

The Trainee has the right to terminate the contract, without having to give any reason, within 14 (fourteen) days of the day on which the contract was concluded, and may exercise their right to freely terminate the contract by sending the decision to terminate the contract by post to the address of ACADEMIA CLÍNICAS ESPREGUEIRA, or by email to [email protected]. The Trainee’s right to freely terminate the contract within the deadline is considered to have been exercised when the termination is sent before the deadline expires.

All cases in which the execution and supply of digital content not supplied on a material medium begins with the prior express consent of the customer and the customer recognizes that their consent implies the loss of the right of free withdrawal shall constitute exceptions to the right of free withdrawal set out in the previous point.

In accordance with the GDPR in force, ACADEMIA CLÍNICAS ESPREGUEIRA undertakes not to disclose the data provided to third parties, the use of which is exclusive to the management of the training activity. The personal data provided by trainees and employees is used exclusively for the organization, operation and evaluation of the training activities in which they are involved.

The personal data of those involved in training collected as part of the enrolment and attendance process for any ACADEMIA CLÍNICAS ESPREGUEIRA course, namely name, ID card number, expiry dates, tax number, address, email address, telephone numbers, date of birth, educational qualifications, or others, are processed and included in automated computer files, or in manual files, for which ACADEMIA CLÍNICAS ESPREGUEIRA is responsible.

Personal data is processed exclusively for the purposes of managing the individual files of those involved in the training, as well as for the full fulfilment of the contractual and legal obligations inherent to the course in question, the purposes of which are essentially as follows: management of applications and enrolments, assessment and certification procedures, access control, attendance, timetable and attendance, provision or sending of information and study material, human resources management, remuneration processing, staff selection and recruitment.

The personal data collected from those involved in the training may be passed on to the entities responsible for certifying the course or by virtue of compliance with the rules established in national and international partnerships or agreements in the field of Training, if they exist and exclusively for this purpose, even in these cases, always with the express consent of their holders with the signing of the respective training contract.

The personal data of those involved in the training will only be kept for the period strictly necessary for the purposes for which they are processed.

ACADEMIA CLÍNICAS ESPREGUEIRA may process special categories of data, namely data relating to health, when necessary to fulfil legal obligations to which it is subject, for reasons of public interest in the field of public health, collaborating with the Health Authorities in the control of infectious diseases, without prejudice to the right to individual data protection of the respective data subjects.

Any of those involved in the training may exercise their right to object, to information, access, portability, rectification and deletion of data, by writing to ACADEMIA CLÍNICAS ESPREGUEIRA.

If any of the training participants’ rights in terms of personal data protection are not respected, they may lodge a complaint with the National Data Protection Commission using the form at www.cnpd.pt.

In compliance with Law no. 144/2015 of 8 September, in the event of a dispute, the Trainee has alternative means of resolving consumer disputes and may resort to CICAP – Centro de Informação de Consumo e Arbitragem do Porto with website at: http://www.cicap.pt and headquarters at Rua Damião de Góis, 31, loja 6, 4050 – 225 Porto.

These Training Operating Rules of ACADEMIA CLÍNICAS ESPREGUEIRA – valid for face-to-face and distance training courses, come into force on 1st April 2022.

 

As part of the exceptional and temporary measures to respond to the epidemiological situation caused by the SARS-CoV-2 coronavirus and the COVID-19 disease, imposed by the national authorities, ACADEMIA CLÍNICAS ESPREGUEIRA will favour distance learning training. This recommendation will be in force for as long as the current epidemiological situation persists.
